To provide you with the HAKT Radio™ Service (or "Service", as defined in the Terms and Conditions of Use), Fireside Software SRL ("Company", "We", "Us") needs to collect some information about you, and this Privacy Policy ("Policy") is where We describe the information We collect, what We do with it, and how you can manage and control the use of your information. By using or interacting with the Service, you are entering into a binding contract with Us and consenting to the use of your information as explained in this Privacy Policy. If you don't agree with these terms, then please don't use the Service.

Your use of the Service, and any dispute over privacy, is subject to this Policy and our Terms and Conditions of Use, which are incorporated by reference into this Policy, including their applicable limitations on damages and the resolution of disputes.

The information We collect

Registration Data

When you sign up for the Service, We may collect information We ask you for, like your username, password, e-mail address, date of birth, gender, postal code, and country. We may also collect information you voluntarily add to your profile, such as your mobile phone number and mobile service provider. If you connect to the Service using your Facebook credentials, you authorize Us to collect your authentication information, such as your username, encrypted access credentials, and other information that may be available on or through your Facebook account, including, but not limited to, your name, profile picture, country, hometown, e-mail address, date of birth, gender, friends’ names and profile pictures and networks. We may store this information so that We can provide you with an improved user experience.

Usage & Log Data

When you use the Service, We may automatically collect information about your use of the Service, including: (i) interactions with the Service, including song and station selection and playlist creation, (ii) the details of the queries you make, (iii) tehncial data, which may include the URL you are coming from, your IP address, unique device ID, network and computer performance, browser type, language and identifying information, operating system, and HAKT Radio application version; and (iv) location information.
We may store collected information in locations outside of our direct control (for instance, on servers or databases co-located with hosting providers).

Other Services

You may integrate your HAKT Radio account with third party services besides Facebook (“Other Integrated Services”). If you do, We may receive, use and share the categories of information described above, including information made publicly available on or through your account of such Other Integrated Service, in accordance with this Privacy Policy.

How We use the information We collect

We may use the information We collect, including your personal information, to: (i) provide, personalize, and improve your experience with the Service and products and services made available through the Service, for example by providing customized or localized content; (ii) ensure technical functioning of the Service and products and services made available through the Service, develop new products and services, and analyze your use of the Service, including your interaction with applications, products and services that are made available, linked to or offered in the Service; (iii) communicate with you for Service-related purposes, including promotional e-mails or messages; (iv) enable and promote the Service, including features and content of the Service and products and services made available through the Service, such as sharing, user interactions, notifications and suggestions, and integration with third party services; (v) enforce this Privacy Policy, the Terms and Conditions of Use, including to protect the rights, property or safety of HAKT Radio, users or any other person and the copyright-protected content of the Service; and (vi) as otherwise stated in this Privacy Policy.

We may share the information We collect, including your personal information, as follows:

Sharing with Facebook and Other Services

If you connect to HAKT Radio using Facebook or otherwise connect your HAKT Radio account to an Other Integrated Service, HAKT Radio may provide a mechanism that allows you to share your activity and activity-related stories with that service, including the music you listen to. HAKT Radio will obtain your permission before posting on your behalf to any such service. You understand that such information may be attributed to your account on Facebook or Other Integrated Service and may be published on such service.
HAKT Radio may also enable you to share a particular item of content, on an individual basis, to third party services by using the share functionality in the Service. To share an individual item of content to a third party service, you’ll be prompted to enter your access credentials for that third party service. HAKT Radio may store your username and an access token or similar credentials obtained from the third party service, so that you are able to share particular items of content on that third party service on an individual basis without entering your access credentials again.

You understand and agree that Facebook's or other third parties' use of information they collect from you is governed by their privacy policies, and HAKT Radio's use of such information is governed by this Privacy Policy.

Other Sharing

In addition to the above, We may also share your information to third parties for these limited purposes:

  1. Affiliates. We may disclose the information We collect from You to our affiliates or subsidiaries; however, if We do so, their use and disclosure of your non-personally identifiable information will be subject to this Policy.
  2. Other Third Parties. We may disclose the information We collect about You to other third-parties for marketing, research, products and/or other services.
  3. Service Providers. We may disclose the information We collect from You to third-party vendors, service providers, contractors, or agents who perform functions on our behalf.
  4. Business Transfers. If We are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, We may transfer the information We have collected from You to the other company.

  6. To Protect Us and Others. We also may disclose the information We collect from You where We believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use Agreement or this Policy, or as evidence in litigation in which We are involved.

We may also share your information for other purposes, if You have granted Us consent to do so.
You agree and understand that the privacy policies of the third parties will govern all use of information that We provide to them or that they collect from you.

Our use of cookies and other tracking mechanisms

When You interact with our Service, We strive to make your experience easy and meaningful. We or our third-party service providers may use cookies, web beacons (e.g., clear GIFs), and/or similar technologies to track user activity and collect Service data. By continuing to use our Service, You are agreeing to our use of cookies and web beacons on your device.

Cookies. We (or our third-party service providers) use cookies to track visitor activity on our website ("Site"). A cookie is a text file that a website transfers to your computer's hard drive for record-keeping purposes. Clear GIFs, pixel tags and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer's hard drive, clear GIFs are embedded invisibly on web pages. We and our third party service providers may use clear GIFs (a.k.a. web beacons or pixel tags), in connection with our Site to, among other things, track the activities of visitors, help Us manage content and compile information about usage. We and our third party service providers also use clear GIFs in HTML e-mails to our customers, to help Us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.

Third-party Analytics

We may use automated devices and applications, such as Google Analytics, to evaluate usage of our Site. We also may use other analytic means to evaluate usage of our Site. We use these tools to help Us improve our Site, performance and user experiences. We do not share your personally identifiable information with these third parties.

Children's privacy

Protecting the privacy of young children is especially important. For that reason, We do not knowingly collect or solicit personal information from anyone under the age of 13 in accordance with the Children's Online Privacy Protection Act. We urge parents and guardians to supervise their children's Internet usage. If You are under 13, please do not send any information about yourself to Us, including your name, address, telephone number, or email address. No one under age 13 is allowed to provide any personal information to Us on our Service. In the event that We learn that We have collected personal information from a child under age 13 without verification of parental consent, We will delete that information as quickly as possible. Communications and marketing

As permitted by applicable law, We may send periodic promotional or informational emails to You. You may opt out of such communications by following the opt-out instructions contained in the e-mail. Please note that it may take up to 10 business days for Us to process opt-out requests. If You opt out of receiving emails about recommendations or other information We think may interest You, We may still send You e-mails about your account or any services You have requested or received from Us.

Security

To ensure the appropriate use of information and protect against the loss, misuse or alteration of information under our control, We have put in place appropriate physical, electronic, and managerial procedures to protect the information We collect online. Despite our best efforts, no data security measures can guarantee 100% security.

Changes to this policy

This Policy is effective as of the Effective Date above, and is subject to change. We may make changes to this Policy from time to time. Your continued use of this web site and our Service after We post a revised Privacy Policy signifies your acceptance of the revised Privacy Policy.
